That depends on what your stipulation stated. Was the other party to pick up the equipment in 10 days or were you to return the equipment in 10 days? The result is the same, but the burden is different. If they were supposed to pick it up and did not, then there is no breach. If you were supposed to return it and did not, then there is a breach.
