"LIVING TRUST 를 만드시며 부모님 집이 제게 양도되었습니다." ?


LIVING TRUST가 아니네요 . . .


부모님(Grantor)이 질문자분을 Remainder beneficiary, or “future owner(grantee) 로 하여

해당 집을 GRANT DEED With Retained "Life Estate" 로 등기 하였다가, 


"Because beneficial use does not transfer to the children until the death of the last life tenant, there is
no change of ownership until that event occurs."


3년후 부모님 “life tenant” 의 해당 집에 대한 
all life estate interest를   

("QUITCLAIM DEED" 양식을 사용하여) 질문자분 “remainderman” 에게 양도하며 
 
"Life Estate" 가 종료한 것으로 보이네요.


일반적으로, 질문자분의 집 매도 (양도)시에  "GRANT DEED" 양식을  사용하여

구매자가 그 GRANT DEED를 등기하여 집을 소유하게 되는데요 . . .

"A grant deed is a property deed that is used to transfer ownership of real property
from a grantor (the owner of a property) to a grantee (the buyer).

When a grantor offers a grant deed after the sale of property,
they are guaranteeing that there have been no problems with the title
during the time that the grantor has held it, and that
the property has not already been transferred to someone else. "

"In California, a quitclaim deed is a legal document used
to transfer ownership of real property.
As the name implies, the quitclaim allows an owner to quit his claim to the home.
Quitclaims commonly are used when gifting property.

Quitclaim deeds are usually used in family situations
where one party releases some or all rights to the property.
There are no claims of warranties to the property
such as a release or disclosure of all possible liens,
encumbrances or improper title issues. "
