It is not a criminal offense to swear at someone. However, if you throw something at a person (even if you miss) or hit, spit, push or make any unwanted contact, it is a criminal offense.
If the person is a family member or in some personal relationship, he/she could also be charged with domestic violence as well.
Sentence (punishment) for assault and battery can very greatly depending on the court and how severe the action was.
