Your facts doesn't add up. For automobile cases, it must be filed with the court within 2 years from the date of accident. If not, it can be dismissed for statute of limitation.
Of course, in your case, you had insurance on the date of the accident so it doesn't matter that it was cancelled later on. If you in fact had insurance, you must deliver the lawsuit to your insurance company so that their attorney can handle it for you for free.
