Contracted with a builder to build a new home mid Dec 2017, didn’t even start at all until mid March 2018. No updates unless the buyers requested information when they had promised they will do weekly updates. Probably three updates from December 2017- June 2018 and gave us updates when we complained them not giving us update. If I had question about the building, it would take weeks and multiple texts and calls and complaints to get an answer. Ceiling height was very important to us when making decision. When we asked the ceiling height prior to signing contract, it was going to be 10’ first floor and 9’ second. When we went to see our house during construction, both floor measured to be slightly less than 9’ and we brought this to their attention. They admit they gave us wrong information prior to signing contract, but option they are giving is start a new house on a different lot with the ceiling height they said they would build, or give back all the invested money back and void the contract. First option does not work for us because all the lots that are left now are almost 2000sqft smaller than our lot we are building right now. And now they are looking to finish Jan or Feb 2019, and we are expecting a newborn at the end of Jan 2019 and is worst time to move into a new house. Feel like it’s ridiculous we have to do this when mistake was on their end. Also second option, I feel it is so unfair where we sold one of our house (rushed to sell to prepare the money on time) and we have our second house on the market. We have spent a lot of time, money,effort and all that stress! now we are left only with just getting our money back with no compensation. Is there a law to protect the buyers from this and get some form of compensation? Or can we ask them to build on the same lot with the height they told us (according to them, they will not fix the ceiling height, it’s too late. And we kept asking to verify ceiling height and didnt answer our question the longest time.) only if they had communicated with us better and updated us, this would have been prevented.
