Escrow on short sale home is about to close this month. However, seller still hasn't signed the approval agreement because they don't like the fact that bank can go after them for more money later. Because agent told me the bank approved and i have a copy of email stating short sale approved and that was sent by the lender. Therefore,
my question is i already paid escrow $5000, done home inspection, and paid bank application fees. They were all out of my pocket. What if
it doesn't close by the time frame which is only 30days? they said everything will be voided if not closed by the 30th day. i am just worried in case this sale doen't go through. is there a way i can claim through the seller since this is due to seller's negligent? Plus, because of their ignorant, short sale process took longer than usual. same location, other unit only took 4 months, mine took 7months. what can be done? please advise.

Your question should be answered after purchase contract & escrow instruction are reviewed. My answer is based on normal and customary practice in short sale process. I believe the purchase agreement has been agreed and executed subject to Seller's Lender's approval on short pay off.. If sale does not go through as agreed per purchase agreement, you are entitled to get refund of your deposit money from escrow. And it is normal practice that escrow will deduct escrow cancellation fee, any expenses occured during escrow like natural hazard disclosure report., messanger fee......etc from your deposit money. You paid for home inspection and loan application fee and those money will not be compensated by Seller or by Broker unless othwerwise agreeed in purchase contract. Short sale takes longer time than normal and regular sale and there is no time limit because the agreement is made subject to Lender's approval. The best way is to contact your Broker and get an advice.
