Q.Website Accessibility Lawsuit 관련 문의

안녕하세요,

리테일 비지니스를 운영하고 있는 사람입니다

Blind California consumer 이라는 곳에서 우리 웹사이트가  장애인들이 사용하기에  불편 하다는 이유로 고소하겠다고 변호사를 고용하여 통보를 해왔어요.  심지어 상품 판매도 하지 않고  몇 년 간 방치 해 놓은 상태였으며 최근 업데이트 중 이었는데요

메일 내용에는 변호사에게 법적인 상담을 받으라는 안내까지 해온 상태인데 이런 경우가 처음이라 어떻게 대응해야 할지 모르겠어요. 지인을 통해 들은 예기는 고소인이 피해를 받지 않았으면 고소를 해도 법원에서 기각된다고 하던데 어떻게 대응 해야 할까요?

안녕하세요, 맨하탄에 위치한 법무법인 유율(Yuyool Law)의 김성균 변호사입니다. 


실제로 캘리포니아가 포함되어 있는 제 9 연방 순회법원에서 도미노 피자와 Robles라는 시각 장애인 간에 비슷한 법적 분쟁이 있었는데, 도미노 피자가 졌습니다.  Robles는 screen-reading 소프트웨어를 이용해서 인터넷을 이용하고 있었는데, 도미노는 accessibility를 제공하지 않았었어요. 최소한 두번 정도 Robles는 온라인으로 피자를 오더하지 못했고, 도미노가 웹사이트와 핸드폰 앱이 자신이 사용하던 소프트웨어가 읽을 수 있도록 디자인 하지 않았다는 이유로 Robles는 도미노를 상대로 damage와 injunctive relief를 요구하는 소송을 했습니다.


Public accommodation (도미노 피자 가게도 포함됨)에 적용되는 ADA의 요구사항이 도미노의 website에도 적용이 될 수 있느냐가 중요한 이슈중 하나였는데, 도미노의 웹사이트나 앱에 접근할 수 없다는 것은, 이미 public accomodation으로 취급되는 physical pizza franchises 의 서비스를 접근을 방해하는 것이므로 웹사이트에도 ADA의 요구사항이 적용된다고 결론을 내렸어요. 


이 분야 관련 소송은 계속 증가해 오고 있는데요, 전문가와 함께 받으신 편지에서 말하고 있는 사실관계에 대한 분석이 더 필요한 것 같습니다.

[On Wednesday, in Gil v. Winn-Dixie Stores,
the 11th U.S. Circuit Court of Appeals vacated a 2017 trial-court ruling that
the grocery chain violated the ADA because Juan Carlos Gil, a visually impaired customer,
could not use its website and was thus denied equal access to all of Winn-Dixie’s services.

The 11th Circuit concluded both that websites are NOT
a “public accommodation” as the ADA defines the term and that
Winn-Dixie’s website did not create an “intangible” barrier to its services." ]

"California AB 434 and the WCAG Guidelines
ADA website compliance California AB 434 requires
all state agencies in California to ensure that
their websites conform to Level AA standards of WCAG 2.0.
This also include contractors working for these agencies."

" California Civil Code section 5, the Unruh act is the law that
prohibits discrimination from business establishments.
It was enacted in 1959 and was later amended in 1992
to apply to persons with disabilities.

Because of the Unruh Act, the violation of ADA is a violation of the Unruh Act.
That said, any website that is not ADA-compliant will violate federal law and the Unruh act.

If you win your lawsuit, you’re entitled to up to 3x the actual damages and
at least $4,000 in statutory damages.
Additionally, these damages include emotional distress.

On the other hand, plaintiffs are only entitled to attorney’s fees and
injunctive relief under the ADA.
Meaning that it’s more lucrative to file accessibility claims in California
because the penalties are higher."

"California Consumer Privacy Act

CCPA is another law related to accessibility.
The CCPA requires that businesses give their customers the right
to know how they use their personal information.

These include details like email and shopping history.
Though CCPA mainly focuses on consumer rights, notices, and processes,
businesses often ignore accessibility requirements.

A clause in the Act requires business privacy policies to be
“reasonably accessible” to people with disabilities.
Moreover, they should conform to WCAG 2.1 Level AA."

"ADA non-compliance in other states requires you to pay attorney’s fees.
However, a violation of the Unruh Act can result in a minimum of $4,000 in damages.
