BUYER and SELLER understand and acknowledge that if for any reason, other than BUYER'S failure to perform as
required under this section and provided that BUYER is not otherwise in default under the Purchase Agreement and has not
cancelled or withdrawn BUYER'S loan application, BUYER has not obtained a loan commitment by 05/30/2022, then, upon
BUYER'S execution of Escrow Holder's instructions to cancel Escrow and this Purchase Agreement, all sums deposited by
BUYER shall be promptly refunded to BUYER. If BUYER fails to obtain the loan commitment by the date set forth
above, SELLER may, at its option, unilaterally cancel this Purchase Agreement. Should BUYER'S lender delay the
Close of Escrow ("Close of Escrow"), SELLER has no obligation to extend the Close of Escrow, but SELLER may grant an
extension on terms and conditions as provided hereinbelow.

5) You are responsible for paying the Lock-in Fee shown above ("Lock-in Fee") after you have indicated to us your intent
to proceed with the loan application. The Lock-in Fee will be applied to closing costs or retained by us as follows:
a) A portion of your Lock-in Fee based on the percentage shown ("% of Lock-in Fee applied to closing costs") will be
applied toward your closing costs if your loan closes and funds with us prior to the original lock expiration date.
b) If you do not close this loan with us the entire Lock-in Fee will be refunded to you only if:
i) You provided complete and correct credit information and your application is denied, or
ii) Your builder breaches the sales contract by failing to sell you the property, through no fault or influence of
your own, and you submit acceptable supporting documentation;
