Q.영주권 인터뷰 날짜 받고 남편이 사망 한 경우

시 어어니의 초청으로 입국 하여 2년전 영주권 인터뷰 날짜를 받아 놓고 남편이 사망 하셨습니다. 아직 실감도 안나고 한국에 갈수도 없고 해서 그냥 지내 왔는데 배우자인 제게 최근 추방 재판에 출석 하라는 통지를 받았습니다.
재판에 회부 되면 바로 추방 되는지요? 구제 받을 방법은 없는지요?

남편이 영주권 페티션의 원 수혜자 이고 귀하는 원 수혜자의 동반가족이기 때문에 원 수혜자가 영주권을 받지 못하면 동반가족도 영주권을 받지 못합니다.
안타갑게도 별다른 구제책이 없군요.

추방재판에 회부되면 바로 추방되는것이 아니라 소정의 절차를 통하여 추방 또는 자진출국령이 떨어지게 됩니다. 즉 재판에 회부되었다고하여 바로 추방되는것은 아니라는 것 입니다. 또한 이민판사의 결정에 불복하여 항소를 제기하실 수 있고 그 동안은 체포의 염려없이 미국에 체류할 수 있습니다.

추방재판에 출석하지 않으면 궐석재판으로 추방명령이 떨어지게되어 앞으로 더욱 힘들어 질 수 있습니다.

Please discuss your case with immegration attorney as soon as possible.
Do not attend at deportation trial without attorney.
Attorney will find the way you can stay in USA and attorney will delay the trial date in order to prepare the documents for you to stay or to submit a pettition of immegration.
As long as I know, there will be two ways to stay or immegrate in USA, one is by marriage and another one is by employment of church or a company.
You may discuss your problem with your church pastor and elder (incase of presbytrian church.).
I am expecting that your church will petition you for necessary hired church officer i .e., Korean speaking educated person or pianist etc.
I hope you will have a good luck!
