아직 "살아있어 보이는" 비자라고 해야 정확할 것입니다.
관계규정이란 이민법 222(g) 항의 내용인데, 아래에 관계규정 원문을 옮겨 보았습니다. 그 아이가 오버스테이 한 날부터 그 비자는 무효가 된다는 내용입니다. 그 다음 내용은 새로 입국하기 위해서는 무효가 된 비자 외에 다른 새로운 비자를 영사관 (한국은 대사관임) 에서 받아야 한다는 내용입니다. 도움되시길...
222(g) Nonimmigrant visa void at conclusion of authorized period of stay.--
222(g)(1) In the case of an alien who has been admitted on the basis of a nonimmigrant visa and remained in the United States beyond the period of stay authorized by the Attorney General, such visa shall be void beginning after the conclusion of such period of stay.
222(g)(2) An alien described in paragraph (1) shall be ineligible to be readmitted to the United States as a nonimmigrant, except¾
222(g)(2)(A) on the basis of a visa (other than the visa described in paragraph (1)) issued in a consular office located in the country of the alien's nationality (or, if there is no office in such country, in such other consular office as the Secretary of State shall specify); or
222(g)(2)(B) where extraordinary circumstances are found by the Secretary of State to exist.
