안녕하세요

시민권자의 아들 초청으로 이민비자를 신청하고 있는 엄마입니다.
NVC에서 welcome letter를 받아 서류를 준비중인데
재정보증 서류에 문제가 있어 문의드립니다.

아들이 대학생이라 수입이 없어 다른 미시민권자로 부터 보증을 받으려 합니다.
문제는 이 보증인이 한국에 있는 국제학교에 근무하고 있어 미국에 거주하고 있지 않습니다. 세금도 한국에 내고 있다고 하네요.

이분을 보증인으로 세울 수 있나요?

참고로 아래 자료를 보면, 세번째 항목에 "미국 회사에 고용되어 한국에 근무하고 있으면 미국내 거주가 있는 것으로 간주할 수 있다"고 되어있는데

한국에 있는 학교가 비록 상행위를 하는 영리회사는 아니지만 미국인이 운영하는 학교이므로 넓은 의미에서 U.S firm or corporation에 해당한다고 볼 수 있는지요?

Note that the USCIS regulation provides that sponsors who can show that they had a domicile in the United States, but who are now living temporarily abroad because of certain types of employment, shall be considered to have retained their domicile in the United States.

A sponsor retains his or her domicile for the following types of employment:

• Employment by the U.S. government
• Employment by an American institution of research recognized by the Secretary of Homeland Security
• Employment by a U.S. firm or corporation engaged in whole or in part in the development of foreign trade and commerce with the United States, or a subsidiary of such a firm
• Employment with a public international organization in which the United States participates by treaty or statute
• Employment by a religious denomination/group having a bona fide organization within the United States and is stationed abroad with that religious denomination
• Employment as a missionary by a religious denomination/group or by an interdenominational mission organization within the United States and is stationed abroad with that religious denomination

라고 말 하고 있습니다.

귀하의 재정 보증인이 되시고자 하는 분의 경우에는,
2. You are living abroad temporarily.
If you are not currently living in the United States, you must provide proof that your trip abroad is temporary and that
you have maintained your domicile in the United States. Examples of proof include:
A. Your voting record in the United States;
B. Records of paying U.S. state or local taxes;
C. Having property in the United States;
D. Maintaining bank or investment accounts in the United States;
E. Having a permanent mailing address in the United States; or
F. Other proof such as evidence that you are a student studying abroad or that a foreign government has authorized a
temporary stay.

실제로, 이러한 경우에 있으시고, 이를 서류로 준비하셔서 입증하실 수 있다면,
재정 보증인의 "미국 거주" 자격을 인정 받을 수 있다고 설명하고 있습니다....
