안녕하세요

문의를 드립니다.

 

큰 Community 거주자인데, 최근에 토잉을 당했어요.

3일 이상 옮기지 않았다는 이유인데요.

이 곳은 Parking Regulation / Not Gated 이 있는 단지입니다.

 

2.2.4. Permitted vehicles, as specified in Section 1.1 of this document, parked in excess of 72 hours



2.2.5. Any vehicle on City public streets between the hours of 2 a.m. to 5 a.m. is prohibited by City law unless posted to allow parking by the City.



4.2.2. If a vehicle is in violation of Section 2.2 of these rules, the vehicle can be issued a citation. Vehicles in violation of Section 2.2.5 will be cited and fined by the City of Fullerton. For vehicles in violation of Section 2.2, with the exception of Section 2.2.5, a written warning will be provided before the vehicle is towed.



이렇게 되어있는데요.

3일간 Tag 를 달아놓았고 바로 토잉을 했습니다.

그래서, 제가 항의를 하니까

"Tag 가 Citation 이다. 우리가 차 주인이 누군지 알고, Written Mail을 USPS 로 보낼 수 있나. 작성하고 보내는 시간에 Parking Rule 은 쓸모없어 질 것이다" "난 십여년의 경력이 있는 사람이다"

이런 말도 안되는 회신을 보내왔어요.

Since owners do not register their vehicles in this section of the community, what you suggest below is logistically impossible. Neither Action nor the Board have a way to send owners a letter for stored vehicle since we cannot tell who owns the vehicle; even if we had vehicles registered, the time to draft and for USPS to mail an owner the letter would make the parking policy of no service. In section 4.2.2, the written warning is the tag left on the van n 6/6, and the tow occurred on 6/9.



그리고서는, 제가 6/9일에 항의를 하고 난 후, 6/18일에 제 옆에 늘 파킹하는 차에 분명한 "Written Notice"를 붙였고, 다음날 그 차는 토잉 되었습니다. (사진 있습니다)



너무 당당하게 이상한 방어를 하더니, Board of Directors 에서도 Reimbusement 을 거절 했습니다.

Denial Letter 를 보냈다고 해서 안왔다고 했더니,

"우리는 USPS 를 Control 할 수 없다. Case Closed" 라고 이멜을 보냈습니다.

 

분명 Tag 가 Citation 일 수 없고,                               

Written Notice 후에 차를 토잉 할 수 있다는 Black Letter 가 있는데요.

 

Small Claim 을 하려하는데, 혹시

Customarily, Parking Regulation의 Citation, Written Notice 부분을 해석하는데 위와 같은 특별한 

해석방법이 있나 해서 문의를 드립니다

글 올리는 사람들, 다 본인 위주로 억지 해석 하려니 다 억울한 피해자겠지.

노란줄로 자기가 써놓고 이해를 못했나 보네
" a written warning will be provided before the vehicle is towed."

마찬가지로 프리웨이에 차 퍼져서 세워 놓으면 순찰대가 형광 태그 붙히고 72시간 후에 towing 해감

Tag 에 Black Letter 로 쓰여진 내용 문구가 Written Notice로
토잉하기 전의 'Written Notice'로 보이며

' 2.2.4. . . . parked in excess of 72 hours' 의
이유로 'citation'을 받으셨네요.

citation은 경고가 아닌 벌금 딱지고 해당되는이유는 여러가지가 있겠지만 (인도 침범, 도로 침범, 소화전 앞 주차, 말소된 등록 차량 등등), 질문자 차는 그에 해당되지 않는 72시간 이상 ABANDONED VEHICLE 로 분류되서 딱지 대신 경고 TAG 을 붙힌거고 법이 정한대로 72시간 후에 토잉을 한것이므로 모든 책임은 차주에게 있슴.

토잉하기 전의 'Written Notice'로 보이며

이유로 'citation'이 발부되었고 그기에 따라
벌금 부과와 차량이 토잉됐네요.

가끔 시 또는 주 정부에 도네이션하는 일이 생기더군요. ^ ^
