State of California Franchise Tax Board 에서 California Middle Class Tax Refund 1099-MISC 편지 받았읍니다.

세금 보고에서 인컴으로 보고를 해야 하나요?

보고를 해아 한다면 Income이 높아져서 Refund/Pay amount가 낮아지는건가요?

이미 1099-Misc를 포함안하고 파일했으면 어떻게 해야 하난요?

연방세금보고에서 소득입니다. 지금쯤  다들 1099를 편지로 받으시는 중으로 예상합니다.


만일 MCTR을 보고 누락하면 IRS가 다 잡아내어 추징의 편지를 보냅니다. 만일 실수로 보고 누락했으면 수정보고 하실 수 있습니다. 수정 보고가 안 되면 편지를 받게 됩니다.


CA보고에서는 과세소득이 아닙니다. 별도로 조정해야 합니다.

1099-MISC 소득을 누락하고 보고할 경우 IRS에서 원래 내야할 세금에 벌금과 이자를 청구할 수 있습니다.

금액은 크지 않지만 반드시 포함해서 보고하시기 바랍니다. 개인의 소득에 따라 다를 수 있지만 추가해서 보고하신다고해서 세금이 크게 늘어나지는 않으실 것입니다.

[MCTR을 “refunds” 라고 호칭하지만 . . .
are like the stimulus payments the state paid in 2021 - in effect, gifts.

And according to Publication 525,
gifts aren’t typically reported as income.]

전체적인 맥락으로 보면 김 회계사님이 잘 설명을 해주신 것 같습니다.
일반적인 Taxation 차원이라면 MCTR이라 했으니 CA에서 면세이고 Fed에서 과세이나 1099-Misc가 아니라 1099-G 가 맞지 않았을까 생각이네요.

제 견해로는 명칭은 refund 지만 명목은 경기부양에 가까우니 refund로 보기도 taxable grant 로 보기도 애매하기 때문에 1099 G 로 발행 하기보다는 1099 MISC 가 맞다고 봅니다만
이것이 federal taxable 인지는 questionable 하긴 합니다. IRS 에서 별다른 해석을 내 놓지 않으면
세금보고때 보고를 안 하고 나중에 IRS.에서 편지를 받게되면 treatment 에 관해 싸워볼 수는 있겠습니다. 하지만 금액이 너무 작아서 이도 저도 애매하긴 합니다.

The state Franchise Tax Board 가
MCTR가 ' tax refund' 의 명목이 없으므로
federal tax form (1099-G)를 이슈하지 않았고 . . .

그럼에도 'refund' 라는 명칭으로 MCTR 이 federal taxable 이라고 우기면?
"Don't report any of the refund as income
if you didn’t itemize your deductions on your federal tax return
for the tax year that generated the refund."

IRS 국세청은 the payments 지불금이
연방 보고서에 포함되어야 하는지 여부를 밝히지 않고 있으며 . . .

"They are fixed amounts based on your 2020 income,
regardless of how much you paid in taxes"

저의 소견으로는,
MCTR 도 the stimulus payments 또는 inflation-relief payments 명목으로
federal tax exemption under Section 139 of the Internal Revenue Code
for disaster relief funds로 해석되어
not taxable at the federal or state level이 되리라고 보며 . . .

[IR-2023-23, Feb. 10, 2023

WASHINGTON -- The Internal Revenue Service provided details today clarifying
the federal tax status involving special payments made by 21 states in 2022.

The IRS has determined that in the interest of sound tax administration and other factors,
taxpayers in many states will not need to report these payments on their 2022 tax returns.

During a review, the IRS determined it will not challenge the taxability of payments
related to general welfare and disaster relief.
This means that people in the following states do not need to report
these state payments on their 2022 tax return:

CALIFORNIA , Colorado, Connecticut, Delaware, Florida, Hawaii, Idaho, Illinois, Indiana, Maine,
New Jersey, New Mexico, New York, Oregon, Pennsylvania and Rhode Island. . . . ]
