최 변호사님,

저도 궁금한 내용인데요...

"Lawful Permanent Resident (LPR) = Lawfully Admitted for Permanent Residence (LAPR) = 영주권자"와 "Lawfully Present Alien = 비이민비자를 포함한 합법 체류 외국인"은 다르다고 알고 있습니다.

소셜시큐리티 운영 메뉴얼 (Program Operations Manual System (POMS))에 "Lawfully Present Alien (= 합법 체류 외국인)"도 가능하다고 나오는데요,
"일시적 체류자라 할 수 있는 비이민비자 소지자들은 소셜연금을 받지 못"한다는 규정이 어디에 나오나요?

물론 SSI는 다를 수도 있는데, 이 질문은 본인이 납부한 소셜택스에 의한 은퇴연금 등 (보통 사람들이 얘기하는 SSA)을 뜻하겠지요.

are entitled to collect social security benefits.

E-2 visa holders are not considered full time residents
because there is the presumption that
your job will end and you will return to your country of origin.

For that reason, you would not be entitled to apply for
US social security retirement benefits or Medicare. "

미 시민권자 (U.S. citizen) 또는 영주권자 (난민 포함 lawfully present alien)만이 미국에서 사회보장 연금을 신청할 수 있습니다. 그외 모든 비 이민 비자 거주자는 수혜자격이 된다면, 미국과 사회보장법 조약 체결을 한 나라에 거주할 시 그 나라에서 연금을 신청할 수 있습니다. 한국은 이 조약에 체결한 나라입니다. 비 이민 비자로 충분한 사회보장세금을 내셨다면 한국에서 거주하시면 연금 신청이 가능합니다. 한국에서 가장 가까운 미 사회보장국은 필리핀의 마닐라에 있습니다. 사회보장국에 문의하시면 필요한 정보를 받으실 수 있습니다. 참고: Absence from U.S. territory
Normally, people who are not U.S. citizens may receive U.S. Social Security benefits while outside the U.S. only if they meet certain requirements.
