그리고 영업용이 아닐경우 몇인승까지 가능한지요 또한12, 15인승 운전을 할수

있는 운전면허 CLASS는 그리고 어떤방법으로 면허를 딸수 있는지?

캘리포니아주에서 보통 사람들이 취득하는 운전면허는 Class C입니다.

교회 밴으로 10인 이상은 Class B를 취득하셔야 합니다.

교회 밴을 15인승까지만 운전하실 경우이면 15인승 밴으로 시험을 치시면 15인승까지 운전 가능한 면허증을 발급해 줍니다.

영어로 필기 시험을 치시고 실기 시험을 치시면 됩니다.

시간과 비용은 사람에 따라 다릅니다.
교회에서 픽업하실 목적으로 운전하실 것 같으면, 교인 중에 먼저 취득하신 분에게 가셔서 가르쳐 달라고 하시면 돈은 들어가지 않을 것 같습니다.

우리가 가지고 있는 CLASS-C 라이센스는 운전자를 포함하여 10인 이상,

15인 이하가 탑승하도록 되어있는 승합차를 운전 할수 있습니다.

그러나 밴운전자는 DMV에 유효한 의료인증서와 카드를 소지해야 합니다.

그리고 지난 5년간 난폭운전 , 음주운전, 뺑소니로 기소된적이 없어야

합니다.

Class C driver license - You may drive a Vanpool vehicle designed to carry more than 10 persons, but no more than 15 persons including the driver.

NOTE: The vanpooldriver must have a valid medical certification on file with the DMV and carry a valid medical card.
The driver must keep in the vanpool vehicle a statement signed under penalty of perjury, that he or she has not been convicted of reckless driving, drunk driving, or hit-and-run in the last five years (CVC §12804.9(j)).

교회의 12인승 벤차량과 일반 12인승 밴과의 차이점이 무엇인지요?

교회의 밴차량에 대한 내용을 강조하는데 차량을 구입할때 교회의 이름으로

등록되었다면 그차량은 당연히 상업용으로 분류되어 비영리 단체의 차량으로

CLASS B 면허가 필요하겠지요.

그렇지 않고 개인의 이름으로 구입되어졌다면 그차량은 교회의 밴이아닌 일반 밴으로 구분되어집니다.

그것은 CLASS C의 적용을 받습니다.

관련 질문이 있는데요.... 캘리포니아 드라이브 핸드북은 저도 관심이 있어서 읽어 보았습니다만
제가 이해 하기는 개인 차량에 운전자 포함 15명 이하가 탑승한 차량을 운전할 수 있지만
교회 차량은 상업용으로 분류되는지 비상업용으로 분유 되는지 궁금합니다

오래 전에 저도 교회 밴을 운전한적이 있었습니다.
12인승 밴과 15인승 밴을 운전하였습니다.
그것을 위해서 Class B 운전면허를 취득했었습니다.
Class C 운전면허로는 10인승 이상의 교회 밴을 운전하시면 안됩니다.

교회의 차량은 상업용 차량이 아닙니다.
상업용이라 함은 영리의 목적에 부합되어야 하는 것입니다.
교회는 영리의 목적이 아닌 곳입니다.

자신이 CLASS B 라이센스를 취득했기에 CLASS C가 안된다고 하는것은 이치에 맞지 않습니다.

코드북의 법조항에 나와있는 내용이 맞는 것입니다.

님의 말대로 DMV 홈페이지에 있는 글을 가지고 증명해 보이겠습니다.

아래에 있는 글은 California DMV 홈페이지와 아래에 주소를 복사해 놓은 곳에 있는 글을 복사한 것입니다.
DMV 홈페이지의 표현으로는 nonprofit organization이라고 되어 있는데, 교회가 바로 nonprofit organization입니다.
DMV 홈페이지 커머셜 드라이브 핸드북에 nonprofit organization 즉 교회 밴 10인 이상의 차를 운전할 경우에는 Class B를 가지고 해야 된다고 나와 있습니다.

아래의 글들이 아니라도 Class C를 가지고 교회 12인승이나 15인승 밴을 운전할 수 있는지 알아보는 간단한 방법이 있습니다.
그것은 CHP에게 물어 보시면 알 수 있습니다. 교통 경찰에게 Class C 운전면허를 가지고 교회 밴을 운전해도 되는지 물어보시면 됩니다.

Who Needs a CDL?
To operate commercial vehicles, you must apply for a CDL. Only California residents may obtain a California CDL. Residency is established by any of the following: registering to vote here, paying resident tuition at a public institution of higher education, filing for a California homeowner’s property tax exemption, obtaining a license (such as a fishing license), or any other privilege or benefit not ordinarily extended to nonresidents. You need a CDL if you operate a vehicle or combination of vehicles which requires a Class A or Class B license or Class C license with endorsements.

A commercial motor vehicle is a motor vehicle or combination of vehicles designed or used for either the transportation of persons for compensation or property and:

•Has a gross vehicle weight rating (GVWR) of 26,001 pounds or more.
•Tows any vehicle with a GVWR of 10,001 pounds or more.
•Tows more than one vehicle or a trailer bus.
•Has three or more axles (excludes three axle vehicles weighing 6,000 pounds or less gross).
•Is any vehicle (bus, farm labor vehicle, general public paratransit vehicle, etc.) designed, used, or maintained to carry more than 10 passengers including the driver, for hire or profit, or is used by any nonprofit organization or group.
•Transports hazardous materials requiring placarding.*
•Transports hazardous wastes (Health and Safety Code §§25115 and 25117)


Bus Definition
6.2
Vehicle Code §233, defines a vehicle as a bus when it is designed, used, or maintained for carrying more than 15 passengers, including the driver.
Vehicles designed, used, or maintained for carrying more than 10 passengers, including the driver, which are used to transport persons for compensation or profit (for hire), or used by any nonprofit organization or group are also buses.
Operating a bus or van under the above definition requires the driver to obtain a passenger endorsement.
NOTE: Mechanics who service and test drive these buses must have a passenger endorsement.
Restrictions
6.3
Specific restrictions will be placed on a commercial Class B driver license when the drive test vehicle does not meet federal minimum standards pertaining to the size and weight of the vehicle, and how many passengers it is designed to carry.
The following restriction boxes will be marked on the Certificate of Driving Skill, so the restriction will be added to the driver license, when the vehicle design or condition exists.

Important information about church and school use of vans and busses.
Q. Our church has a 12-passenger van that we use to transport people on church activities. Is our van subject to California safety regulations for “buses”?

A. Yes. The California definition of a “bus” is found in Vehicle Code Section 233:

“A bus is any vehicle…designed, used, or maintained for carrying more than 10 persons, including the driver, which is used by a nonprofit organization or group…”

This section does not apply to vehicles used to transport children to or from school or on any school activity. Those vehicles are governed by separate laws and regulations.

Q. Our church has a van that has seating for 12 persons, including the driver, but we rarely have more than 10 persons in the van. Is our van still subject to the CHP safety regulations for buses?

A. In a word, “YES.” If your vehicle has seating for more than 10 people, it is considered a “bus” for safety regulation purposes, regardless of how many persons are being carried at any one time.

Q. Our church van used to have seats for 12 persons, including the driver, but we took out a bench seat to make room for more luggage in back. Is our van still considered a “bus”?

A. The law does not address this issue, but for many years the CHP has interpreted the law in favor of the vehicle owner or driver. If you have removed a three-passenger seat from a 12-passenger van, it is now a 9-passenger vehicle that no longer meets the definition of a bus. However, Conference Education Department policy prohibits the use of vans with a designed seatinng capacity of 11 or more for school activities even if seats are removed to reduce the seating capacity to less than 11. Q. What type of driver's license do I need to drive a van or bus for my church?

A. You need to have a class “B” driver’s license, with a “P” endorsement for the transportation of passengers. When you take your driving test, the DMV may restrict your license to be valid only for driving certain sizes and types of vehicles.

You must also have a valid medical certificate, which you get by passing a physical examination performed by a doctor or other approved medical professional. The form for this certificate and the standards for the physical exam are available at the DMV.

Some kinds of buses, such as school buses, require a special driver certificate in addition to a class “B” drivers’ license and medical certificate.

아직도 헷갈리는 분이 있을 것 같아 보충설명 드립니다.
아래 글은 DMV에 20년이상 근무한 매니저에게 오늘 직접 문의한 것이니 맞을 겁니다.

매니저가 말씀하시길 차를 상업용으로 사용하든지 안 하던지 두 경우다 10명 이상을 태우는 어떤 차이건 커머셜 면허가 필요하다. 상업용 차량이 아니라도 커머셜 면허가 필요하다는군요.

단지 11명에서 15명 태우는 VANPOOL 은 그냥 CLASS C 면허로 운행해도 되나 교회차량은 VANPOOL 차량이 아니므로 CLASS C 면허로 운행하면 안 된다고 하십니다.
