안녕하세요

주식투자를 위해 메릴엣지 account를 open하였습다.

아직 투자는 안했는데,, 주변 다른 분들이 다들 말립니다. 그이유는,,,

세금보고가 복잡하고,

단기투자와 1년이상 장기투자의 세금이 다르며,

매수매도를 반복적으로 하고, 손해를 본 후 신고누락시 매도금 전부를 수익으
로 잡아서 세금이 엄청 나온다고 하는데,,,

역시 안하는게 나을까요?

한국에서는 그냥 사고팔면 알아서 세금띠고 끝이었는데,,,

1 세금보고는 매년 세금보고용 서류가 나오면 그것을 가지고 하면됩니다. 어차피 세금보고를 안할 생각이 아니었다면 주식투자를 하고 안하고에 따른 무슨 큰 차이가 없을텐데요.

2. 세금이 엄청 나올 이유가 없을 듯합니다. 투지소득은 세금이 다른 근로소득에 비해 낮습니다. 간혹 세금은 열심히 일하는 사람보다는 돈 있는 자의 편이라는 생각이 들기도 합니다.

3. 소득의 일부에 해당하는 세금을 내기 싫어서 소득을 벌지 않고 포기하겠다는 것이 이해가 안가는 논리 아닐까요?

4. 제가 생각하는 문제는 세금이 아니라 개인이 주식투자로 정말 돈을 벌 수 있느냐의 문제일 것 같습니다.

1. CAPITAL ASSET (Schedule D), Line 13
Definition: 순양도 소득은 OI 보다 낮은 세율, 양도 손실공제 제한이 잇읍니다.
Most property you own and use for personal purposes, pleasure, or investment is a capital asset.
For example, your house, furniture, car, stocks, and bonds are capital assets. • Depreciable property used in your trade or business, even if it is fully depreciated.
• Real estate used in your trade or business.
• Copyrights, literary, musical, or artistic compositions, letters or memoranda, or similar property (a) created by your personal efforts; (b) prepared or produced for you (in the case of letters, memoranda, or similar property); or (c) that you received from someone who created them or for whom they were created, as mentioned in (a) or (b), in a way (such as by gift) that entitled you to the basis of the previous owner. But see the Tip on this page.
• U.S. Government publications, including the Congressional Record, that you received from the Government, other than by purchase at the normal sales price, or that you got from someone who had received it in a similar way, if your basis is determined by reference to the previous owner's basis.
• Certain commodities derivative financial instruments held by a dealer and not connected to the dealer's activities as a dealer. See section 1221(a)(6).
• Certain hedging transactions entered into in the normal course of your trade or business. See section 1221(a)(7).
• Supplies regularly used in your trade or business.


2.Short Term Capital Gain/Loss (STCG/L) = property held for 12 months or less (1년 이하)
Long Term Capital Gain/Loss (LTCG/L) = property held for more than 12 months (1년 초과)

Net CG/CL computation
1. Net long-term gains with long-term loss
2. Net Short-term gains with short-term loss
3. If, netting results in a gain short term gain portion is reported as gain and taxed at individual tax rate Collectibles gain portion is taxed at 10% for taxpayers in the 15% tax bracket and 20% for taxpayers in the remaining tax bracket.
4. If netting results in a loss, loss is deductible up to capital gain and additional $3,000 against ordinary income. Short-term capital loss is deducted first. When there is excess of capital loss, the excess is carried forward indefinitely while retaining its identity (short term or long-term)

즉, 개인은 3,000불 가지의 손실은 OR 에서 상계처리 가능합니다.
나머지 손실은 무제한 이월공제 가능합니다.

3.추가로 한국과는 다른 개념이 잇읍니다.

Here are the income thresholds that might make investors subject to this additional tax:

세금보고는 구좌있는회사에서 년초에 지난일년동안 트레이드한 총계산서를 보내줍니다. 그것에기해보고하시면 복잡할것앖읍니다. 세금은 많이벌어서 많이내면 됩니다. 경험이 없으시면 당분간 경헙있는분과 하면서 배우시길 권장합니다. 조심해서 하시면 좋은 결과를 기대하실수 있읍니다.

매도 매수를 자주하였을때 손실을 인정해주지 않는것은 wash sales rule 을 말씀하시는것 같습니다. 같은 종류의 주식을 매도 후 30일 이내에 다시 구입하시면 wash sale rule 이 적용되어 말씀하시는것과 같이 loss 를 인정받지 못하게 될 수 있습니다. 일반적으로 주식을 통해 돈을 버시게 되면 잃게 되는 경우도 있고, 이럴때 주로 번돈과 잃은돈을 합산하여 차액에 대해서만 세금이 부과되는데요, 이때 잃은돈을 인정받지 못하게 되는것입니다.

1년 이상 보유한 주식을 파셨을때는 capital gain 이 되며, 1년 이하일 경우 ordinary income 이 되어 다른 세율로 세금을 내시게 되는것은 맞습니다만, wash sales 가 아니라는 가정하에 돈을 버신 금액에만 세금을 내시게 되므로 세금때문에 투자를 못하실 이유는 없을것으로 생각됩니다.

궁금한 세금관계를 확인하고, 투자를 할지 말지 결정하는 건 당연한 겁니다 .
그런 의미에서 remo님, Orange3님, yksarang80 님의 답변은 도움이 많이 되었습니다.
예를 들면,, 1년 동안 A 종목을 매매하여 1000달러 수익이 나고, B 종목을 매매하여 500달러 손해를 봤다면,, 500달러에 대한 세금을 낸다는 것인지요.?
이건 수익난 종목(1000달러)에서만 세금을 내는 게 아니니, 투자 입장에서는 합리적이고 좋은 제도네요...
