부동산 명의/모기지

집 명의가 제 이름으로 되어있고 부모님 이름으로 론/모기지가 되어있는데 집 페이먼트를 못할경우 명의가 누구인지 상관없이 foreclosure 당할수 있는건가요? 론/모기지 회사가 어떤 권리를 갖고있는지 궁금합니다.

상식선에서 말씀을 드리자면 담보권이 설정된 모기지의 경우 (DEED OF TRUST로 융자후에 자신들의 담보권을 확보) 모기지 연체시 차압이 가능한걸로 압니다. 간혹 주택의 소유자와 모기지의 이름이 다른 삼자일경우들이 있습니다. 이분들이 비록 명의즉 타이틀에는 없더라도 채무에 대한 책임을 지셔야 하며 차압후 가능한 여러가지 추가 추심절차등에 대해서는 변호사와 상담을 한번 하시기 바랍니다. 참고 하세요
